Do You Understand No-Fault Insurance?

The damages in a car accident may include medical expenses, lost wages, permanent disability, and pain and suffering, plus property damage to your vehicle. As a “no-fault” state, Florida law requires that every vehicle registered in the state be covered by Personal Injury Protection insurance (PIP). This means your own insurance company pays your initial damages, regardless of who is at fault.

However, PIP insurance is capped. It only covers minor injuries or a portion of major injuries. If your damages exceed the no-fault limits, you will have to bring a claim against the other driver to recover the difference. If the other driver did not have liability insurance, you may be able to bring an uninsured motorist claim under your own policy.

No-fault claims also have a time limit; you must receive medical care within 14 days of the accident. If you do not file your no-fault claim before the deadline, you may be limited in the amount of PIP benefits you’ll receive.
